Prophet,

I didn't realize there were two different actions in the U.S.

What's the difference?

TIA,

Dave

Prophet: I don't think injunctive relief can be sought in ITC rulings, only civil court. Lawyers, please correct me if I am wrong.

For those of you wondering what injunctive relief means, it is the distant cousin of a temporary restraining order. Puts a stop to the infracting actions (in this case, importation DRAM product), until the court makes a determination.

Sniffed around the ITC site and found the following:

1. 45 day window refers to setting a target date for completion of investigation: usitc.gov

2. This appears to have already been done, and the deadline / target date (for completion / final determination of investigation) is June 24, 2001:
info.usitc.gov
-- click on Section 1 ("Hearings..."), download, and go to end of .pdf document

3. Status of the case appears to be "In adjudication before Admin Law Judge".
info.usitc.gov
-- click on Section 3, download, and scroll to page 3

4. If you wish to see all non-confidential filings in this case, go to:
dockets.usitc.gov
-- click "337" (left side)
-- click on 337-431 "sdram"

That nothing has come out of the Delaware courts at this point would be worrisome if indeed injunctive relief had been sought at time of filing (those determinations are usually made expeditiously). Can anybody confirm if "IJ" was sought?

Enjoy.
