Duke et al: The guy is the Queen of Hearts!In his interview with the Journal, Jackson was critical of Microsoft, making it clear that his view of Microsoft's truthfulness harmed its defense.

"I had to make judgments about the credibility of witnesses, and I found some of them more credible than others," he told the Journal.

In explaining why he did not give Microsoft extra time to argue against the breakup after it was found guilty, Jackson compared the company to World War II Japan.

"Were the Japanese allowed to propose the terms of their surrender?" he told the Journal. "The government won the case."

Kovacic expressed astonishment that Jackson would make such a statement on a case that could still come back to him if an appeals court remands the case for further consideration.

"It's a reckless choice of metaphor," Kovacic said. "When you speak publicly, outside of the formal process, about a case in which you will continue to play a role, you're walking through a minefield."
