No one could ever proceed with a lawsuit to determine whether the sun rises in the east or in the west. The judge will take judicial notice of the objective fact that the sun rises in the east, and dismiss it. You won't even get to the jury without a genuine issue of contested fact.

Ah, if it is that simple, and you have the objective fact in hand, then just sue the appropriate authorities armed with it and you are all set, isn't that the case? That was my proposal, in case you have forgotten.

Scientific truth, which hopefully is objective truth, is determined by the consensus of scientists, not jurors.

Agreed! I will remind you of this next time I raise the issue of needing a reference from peer-reviewed research before believing common sense and what not as is the norm in this thread.
