Actually, Microsoft is quite open with customers and licensees when it comes to evolving Windows. Microsoft has also included software in Windows developed by other companies and paid them for their inclusion.

As far as Sun being a credible overseer candidate of an impartial but cohesive process, even the Judge in the case they brought against Microsoft has ruled as part of his denial for Sun's copyright infringement motion that they should have provided Microsoft with notice that they did not rather than suing when they did. At the same time, they selectively let Netscape ship non-compliant support during the whole time period. This attack on a competitor with superior technology combined with their clear, self-serving motivation invalidates them as a credible candidate IMHO.
