re: My advice in the previous post.
I should probably make it clear these are untargeted comments and for the thread in general.

Your discussion with the attorney may be correct, however there are not enough attorneys, judges, or courts to handle these sorts of problems, not to mention the time and effort in preparing and serving the necessary papers. Kind of like "how many grains of sand on the beach?"

Gene, RE: According to this attorney, anyone who posts on a public forum is a publisher, and therefore must meet the same requirements a publisher does. If you make a false injurious or a libelous statement you may end up with some legal problems.

Yes, if you make false injurious statements or libelous statements, then there certainly could be some liability there.

But to make this leap...

My advice to anyone who posts negative opinion as if it were fact, (potentially litigious or not), is to start clearly labeling it as opinion. And if you aren't sure your opinion is based on fact, it would also be a service to the uninformed reader.

...is clearly overboard in my opinion <vbg>. Unless a press release is quoted verbatim, just about everything on these boards is opinion. I have seen court cases resulting from posts made on boards here, and it has been very clear that unless a statement is libelous, someone posting negative information in good faith has nothing to worry about.
