Probably not. However, just like the judge refused to accept any argument from Microsoft because he felt that they were lying to him, the appellate court could refuse to accept any of his comments especially when he has stated that his own ruling is at odds with their rulings.
A case could be made for the judge's lunacy. I will compile his comments and let you guys decide...
