In addition to hearing the case, the Appeals Court agreed to hear it en banc, meaning with all of the available justices (7 out of ten right now) presiding instead of the usual 3.

The judges consist of 4 Reagan appointees, 2 Clinton, and 1 Carter appointee. The panel will also include Steve Williams, the author of a favorable paper on Microsoft's position, a paper considered important in Microsoft's defense.

This seems to send a strong message to the Supreme Court that the Appeals Court unanimously feels it is important that they hear the case.


A strong ruling from a panel of 7 justices could well produce an objective and unassailable ruling.

Now the real trial begins.
