Circuit Judges Laurence Silberman, Karen Henderson and Merrick Garland, who worked for the Justice Department until 1997, were disqualified. That left Judges Stephen Williams and A. Raymond Randolph, who were part of the panel that gave Microsoft a previous key victory. The panel also includes Judges Douglas Ginsburg and David Sentelle, who have written skeptically about antitrust law, and they might round out a winning majority for Microsoft. (Bold mine)
