Last chance for TPJ to show independent thinking: a) He should accept stay request. b) He should deny govts request send this directly to supreme court considering appeals court show desire to handle this case.

This is really the last chance for a judge who is at the tail end of his career.

johnd--How can the appeals court nullify TPJ's findings if they are largely not reviewable by the appeals court? Keep in mind, this is still a government of laws, not a government of men. You may think that TPJ's actions are to the contrary, but I don't. As for a settlement, I would hope both sides start very serious settlement talks. Bring back Posner who is a bright as they come and as favorable a mediator as MSFT could hope for. I believe a settlement is the only way that MSFT can "win" here, other than short term benefits due to tactical victories like yesterday's. BTW, its good to see that you have recovered fully from your May mini-depression. Enjoy the ride for the short term, as this will surely be a great week for all of us who are long.
