Portland, Oregon, June 14 (Bloomberg) -- Microsoft Corp. won dismissal by a state judge of a consumer antitrust lawsuit over the Windows 98 operating system, a company spokesman said.

Multnomah County Circuit Judge John Wittmayer's decision is the first to dismiss an antitrust suit against Microsoft in the U.S. since November, when a federal judge decided the world's largest software company monopolizes personal computer operating systems, the company said.

Microsoft spokesman Jim Cullinan said the Oregon case is among 137 that have been filed against the company in 34 states and the District of Columbia. Wittmayer's decision yesterday was based on a U.S. Supreme Court ruling denying consumers the right to bring an antitrust lawsuit unless they purchased a product directly from a company.

The Windows operating system is generally bought by computer manufacturers and loaded on computers before they're sold to consumers.

``This is a very standard application of antitrust laws,'' said George Cumming Jr., a San Francisco-based antitrust attorney.

Plaintiffs attorney David Dean couldn't immediately be reached for comment. The lawsuit alleged that Microsoft charged consumers too much for Windows 98.

Shares of Redmond, Washington-based Microsoft rose 2 5/8 to 70 1/2 on the Nasdaq Stock Market.
