The law says that anti-trust remedies are to be corrective, not punitive. Hence the more competitive the current environment the less drastic the indicated remedy, regardless of the state at the time of the infraction.

Don't get too attached to that idea of Jackson's findings being "fact". His nonsense has been overruled before and he'll be overruled here. His ruling isn't even consistent with itself, much less existing precedent.
