Your post brings to mind a story published a while ago about a medical student stopping to help an elderly man who was lying unconcious in the middle of the road. He stopped his car, assessed the man's condition, called an ambulance, and comforted the man until help arrived. On returning to his car, parked (improperly) he found a ticket under his wiper. True enough, the guy broke the law, and true enough, he's guilty, but most sensible people would view his assistance to the injured man was more than enough to offset his careless parking.

Your post indicates you share the meter-maid's mindset.

...doesn't prove that the consumer was not harmed...

And all along I thought McMealy and his puppets needed to prove consumer harm and not that MSFT needed to prove NO harm.
