It does not necessarily mean that Hitachi will give up, but it lends credibility to RMBS' claims before the ITC and the courts. Technically, neither the ITC nor the courts are bound by any agreement between Toshiba and RMBS regarding RMBS' patent position but, in my view, it will likely influence the triers of fact and it significantly increases RMBS' likelihood of success nonetheless. And since Geoff Tate has said that if Hitachi does not settle he will decline to license them the technology after the fact, it is very, very dangerous for Hitachi to take the risk of losing. Finally, since Hitachi's competitor will be paying the fees anyway, there is no significant competitive detriment to Hitachi agreeing to pay as well.

This news is enormous.
