Is there any way to estimate what a company's true depreciation rate should be?

I recently read that in the US in general that depreciation rates are faster than the reality. If that's true it has some implications for true book values and earnings.

what's your take on this story that RMBS is now suing every memory maker for royalties on SDRAM? and Toshiba apparently giving in voluntarily?
