You may want to look again. The most recent two rulings were against Sun's motions and, while I'm no attorney, it seems that they state it was Sun that violated the license agreement.

It seems that according to the court's interpretation of the agreement, which agrees with Microsoft's, Sun actually violated the terms of its agreement with Microsoft by not providing Microsoft with compatible upgrades for versions of the JDK after 1.0.

According to my layman's read, I believe this denies Sun's motion for copyright infringement and effectively states that Sun should have given Microsoft proper notice in accordance with the agreement rather than suing after discovering some tests that did not pass.
