Kevin - if that is so then I retract my comments as they relate to that consideration alone. However, the "punishment" from the FDA for that kind of rule-breaking is simply a letter asking them nicely to stop.

Since that kind of letter is no longer necessary, since they no longer have to stop marketing their equipment under the pre-FDA auspices, there will probably be no letter of reprimand.

But it doesn't much matter if there is - or if there were one before FDA approval... it is just not a serious enough offense to the FDA - their punishment process is merely a formality with no fines or other actions.
