Hitachi didn't claim to invent the detail. Perhaps they did, perhaps they didn't. It can be hard to figure out exactly what an engineer wrote in a notebook 10 years ago. Instead, Hitachi said that they got it from a JEDEC meeting. What they want from the rest of the memory industry is proof that the idea predated Rambus' patent application. That would be all they need to invalidate the patent.

All the memory makers manufactured SDRAM for years without believing that part of the design was covered by patents that they didn't have. They, and all the analysts for the industry, are quite surprised that Toshiba paid up.
