Don't know, but the handicappers are guessing before october.

On the one hand [ :)] the Supreme Court needs five of nine to grant cert. And, if given the careful cautious approach, nothing will be lost if the facts and the situation is given time to distill. It will make any decision easier, because of that fullness of time stuff.

On the other hand, the C/A has shown a readdiness to hear the case, but I think the briefing schedule that they set was just for the stay issue, which is now moot. (dead)

If, Judge Jackson granted the stay until such time as the Supreme Court will hear the issue, then MS will probably withdraw its motion to review the stay in front of the Appellate Court.

If this is the case, then there is no expedited schedule and the Supreme Court, because of the Defference shown by Judge Jackson, may consider the complex issues at its pleasure.

The interest of justice would seem to require due deliberation. The issue of whether the States part of the case is under the expediting rule, for instance.

In short (yeah, right) the Supreme Court has good reason and opportunity to take its time and to well consider the issues.

On the other hand, maybe Thursday. :)))
