You are complaining about the rules. If the rules stink then their administration will reflect that. Fairness in the administration of rules has to do with whether or not the the administration is consistant with the rules. Was the treatment of the Jews in Nazi Germany fair? Depends on who's rules we are measuring the treatment by. Obviously by modern standards the answer would be no, but we are looking at a different rules base, however, by that standard of rules the treatment violated the rules. How about by the universal standard I mentioned earlier? Then yes, everything is fair because there is not only the opportunity but the guarantee that all will be vindicated in the overall scheme of things.
