Thus far, the FCC has not subjected cable broadband to any regulation, including common carrier telecommunications regulation. We note that the FCC has broad authority to forbear from enforcing the telecommunications provisions if it determines that such action is unnecessary to prevent discrimination and protect consumers, and is consistent with the public interest

The crux of the matter is that the FCC has declined to impose regulation in the interest in not killing off the broadband rollout. This is in the interest of consumers. T and ATHM have already started the multiple ISP trials voluntarily....they are moving to OA without regulation being imposed on them. They have discovered that it is in their best interest to do so.

This ruling leaves one less complication, which is that the local governments have no business placing restrictions, regardless of the negative spin that the news services want to put on it.
