U.S. okays Uniphase, E-TEK merger with conditions

WASHINGTON, June 22 (Reuters) - U.S. regulators Thursday said they would allow the merger of leading fiber optic makers JDS Uniphase Corp. (NasdaqNM:JDSU - news) (Toronto:JDS.TO - news) and E-TEK Dynamics Inc. (NasdaqNM:ETEK - news) to proceed provided they drop their rights to purchase a key component.

The U.S. Justice Department said the two companies had agreed to cancel certain contracts for thin film filters that allow more information to be packed into the optic fibers.

Without the agreement, the two companies would have controlled about 80 percent of the world's output of thin film filters, the Justice Department said in a statement.
