Not at all. Many capital cases can exist without any DNA evidence at all.

Unleadvocate that a case can only be tried as capital if DNA evidence exists and it undeniably links a person to the murder. Even then it is murky. It is possible DNA evidence could exist implicating a person who had contact with the person but nothing whatsoever to do with the murder.
