JC - you keep whipping this horse even though it is obviously dead. First, the EULA says that if you refuse the terms of the license, you do not have the right to use the software, and that you can contact your supplier for any redress. If your supplier doesn't want to give you anything, tough. BTW some Toshiba customers actually got refunds. But there is nothing in the EULA which obligates MSFT to anything unless you bought the software from them, in which case you would get a prompt refund of your purchase price.

Second, you can sell your computer and operating system and the license transfers. The OEM license is for use on that OEM's machine, a point that seems to elude you.
