Thanks. FYI, the adverse ruling was before the International Trade Commission, an administrative body, and not the Courts. I think the courts are better equipped to adjudicate patent issues than the ITC as the threshold is much higher in terms of becoming a US District Court judge.

I think I will try to review the papers in the Court case to assess VISX' prospects. Should become more interesting as the year goes on and the battle obtains greater visibility. Ultimately, I think Bausch and Lomb must fold and reach an agreement or risk being put out of business in the event of an adverse verdict.
