True, the sanctity of life argument introduces inalienable rights and the Creator into the discussion. Any atheist worth his salt would rather slant the discussion to "intrinsic rights" and their relationship to the flawed judicial system.

That's true, dma, but what is also true is that you have governors able to commute (or not) death sentences for political reasons, and I find that unacceptably unfair.
