There is no proof that it is not a deterrent. If only a single innocent victim is saved by the death penalty, it is worth it.

It doesn't matter if it's a close call.

On the one hand you have an individual who, for whatever reason pre-meditated or not, murders someone. That can never be completely controlled -- at least not in a free society.

On the other, you have a flawed, imperfect system designed to execute individuals in a mechanistic, pre-determined way. It is a system which allows for the erroneous execution of innocent individuals. Can this system be corrected and improved upon? Yes.
