I don't see the system as "terribly" flawed, although improvements could be made. (For example, the death penalty should be expanded to all 50 states.)

There is no documented case of a factually innocent person being executed for at least the past 50 years.

Your argument is tautological. Death Penalty must be administered perfectly or it's invalid. It's must be administered by human beings so it's imperfect. It's imperfect so it's invalid.
