Via has probably been notified by RAMBUS of probable patent infringement on the part of their chipsets. This would prompt VIA to take up a defensive position. They are asserting the Hitachi defense as their initial position.
This means that negotiations are probably underway. There will be no lawsuit immediately if VIA agrees to review and negotiate. If they fail to do so then an ITC complaint can be lodged and they can be sued in appropriate jurisdictions.
