An example if I may: What if you are the President and you believe that a person is going to give a nuclear device to terrorists. He is killed by the Secret Service but in fact was only giving terrorists the secret formula to New Coke. You are not guilty of murder because you acted within your official capacity as President. If you order the Secret Service to murder your wife's lover, you have committed a crime outside the scope of your duties as President and you will arrested and charged with murder. Impeachment would follow.
