Alas- what seems not to be understood is that in this "emotional" custody battle the child in question was the citizen of another country and an illegal alien here. The "custody" matter was ludicrous and the only reason ANYONE would support people as pathetic as the Miami Cubans as guardians for a small child was that they were not communist Cubans. I have never seen people so unfit to raise a child- and there is NO WAY if this thing had been kicked to family court that ANY court (except one run by commie haters) would take a child from his father to give him to distant dysfunctional relatives. Of course family court was LEGALLY the wrong place for this matter to be and THANK GOD we follow the rule of law in this country instead of some sort of tyranny of the patriotic tear ducts. "A law abiding American family"- this one had me ROFL. They had an illegal alien in their home they had been ordered to surrender and they belligerently challenged the authority of the US to determine it's own policy over illegal aliens- which is a vital sovereign function.<p>
The INS has complete jurisdiction over illegal aliens. It has the right to give them parole and the right to revoke that parole. It further has the right to decide TO whom parole will be given and by what system parole matters shall be considered. If any citizen of this country- after looking at the ENTIRE scope of INS cases in this area -should feel that the INS is running amok then those citizens should get busy and start helping all the thousands of aliens who would like to stay here in this country and stop concentrating on the two that don't.<p>
Thanks goodness the vast majority of Americans DO have some common sense. I am greatly encouraged by the response of the majority of Americans and bemused by that small minority that will continue to jump up and down and scream about Bill Clinton and Janet Reno.

it was beautiful...As I said, agents will be studying this operations repeatedly this century...THIS is how such operations should be carried out, once again, Bravo to Reno. Less than 3 minutes operation, noone got hurt, actually, the son joins his loving father and escapes the zoo circus...my only complaint was that they did not harm anyone "accidentaly", especially the fisherman, drunk Lazaro or hysterical basket case Marispislesis.

LOL...Over 90% of the occupants of that house (and there were many) and visitors smoked cigarettes (and probably other nice stuff, except, of course Cuban cigars because they can't get any). Plus Lazaro is a drunk...Elian had to breath his drunk smell all the time...Marispislesis constant crying could drive a neighbor insane, let alone Elian...and then u got the fisherman who didn't have time to take a shower because of his constant TV appearances which means he still smelled like fish probably...On top of all that you had a circus 24 hours a day, I wonder how Elian got any sleep...and every time Lazaro took him to church, there were numerous smokers kissing the little boy, disgusting! NO danger my butt! He got away from the zoo when hero Reno finally decided to act (she is kind of slow, you know) and say: ENOUGH! Elian is with his loving family away from the cameras and strangers. He is a normal kid again.

Um, Michael - The father is the father, period. If as you say there is a balance, then it is heavily weighted to one end, and rightfully so. Second point, you have somehow omitted the adjectives 'deluded' and 'propagandising' from between the words 'of' and 'American' ... an oversight i'm sure. Third point - those whackos were the 'emotional custody case' - if they had made no threat on the son of Juan Miguel in the first place there never would have been a dispute. Hoist on their own Bacardi, a mi ver.

There are all kinds of rights, Michael, and they are not all written down on paper, much less amended. The right of parents to speak for and to make decisions for their children is a natural, ancient, inalienable right that no legislature nor jurist nor piece of paper can take from them. You will not convince me otherwise.

... it's quite well written ... the Ley Ambiental is considered among the most advanced on the planet ... interpretation and enforcement have always been problematic though ... the same could be said of Canada and the US ... just a matter of degree.
