Hangmanboothill, are you kidding? While I agree with you that the process may be worthwhile because it is the correct venue, I think it is ludicrous that you suggest that a settlement is in order, especially given the fact that you have presented no evidence to support any allegations.

If the Firm steadfastly denies any and all charges, I will stand with them on their statement. Are you going file a suit and settle with anyone that has an earnings shortfall and warns? Who said anyone was entitled to please the analyst community each and every quarter? Moreover, and conversely, why don't we sue companies for beating earnings estimates and not warning us that they are coming in ahead of projections, or why not sue them for not publishing their business plan and having chat board investors run the business for them?

Making such commentary as a Monday morning quarterback with little or no information serves no one except those attempting to inflame the rhetoric which suits their ulterior motives.
