Since both JDSU and SDLI are US companies, the chance of the US Department of Justice not "reviewing" is about as close to zero as exists in this world.

Since this will probably take months if not years though, it will probably be the DOJ of the next President that rules. (Unless the current DOJ gives this merger a quick pass - suggest not holding your breath for that.)
