Yonsu, I agree. The fact that the customer is not directly affected could help this one get through.
I am expecting a lot of analysts to come out and reiterate buys on JDSU/SDLI tomorrow. My reason is that they will have some time to figure out what areas could be a problem in getting DOJ/FTC approval. I think JDSU already has some idea of what they will be asked for---in terms of divestiture or supply agreements and are probably working on it right now.

The election campaign will be in full swing along with the November election itself. I don't think Joel Klein and Janet Reno really want to create a stir around that time. In addition, if final approval is post election and Bush wins, we could be in a whole new ballgame. JDSU/SDLI could easily take a long time responding to any new second request to ensure it review at a politically critial time. I remember it took them a while to respond to the DOJ's 2nd request in the ETEK merger and they could take a little longer this time.<g>

I think the timing of this deal is great.
