I'm not a tax specialist, but the poster's question was regarding selling PUTs..... I don't think selling a contract fits the definition of an "option to acquire".... just MHO.

the seller/writer does not enter into any contract to acquire or sell securities, that is the buy side of the contract. the seller/writer has a contractual obligation to the buyer to accept assignment or deliver his stock at the demand of the buyer. the buyers contract begins at time of purchase as he has control of a tangible. the sellers contract begins at time of closing, for at this closing time the obligation ends, or he delivers his stock(call write) or is assigned(put write).....now the seller has a "tangible"
