It's obvious to me that the Credit Suisse suit against the Elan 11 is a SLAPP suit (Strategic Litigation Against Public Participation). Some states have adopted anti-SLAPP suit provisions, otherwise, the only chance of getting sanctions (legal fees, damages) in a federal suit is a Rule 11 motion, which aren't granted enough in situations like this. I hope the company and its lawyers get some loathsome disease, but otherwise no retribution is likely here on earth.
