It is voluntary for the individual in that you decide how much tax you are going to pay based on what you buy. You can skip paying Uncle Sam $5 if you decide not to order that second bottle of wine in the restaurant.

The burden of compliance will always be on the retailer, as he owes the tax whether or not he really collected it from you. If he wants to cheat with you, he pays. Same as it is now in the state sales taxes.
