My own feeling is that the tobacco companies are run by a bunch of slimeballs, and that people who file multibillion dollar lawsuits trying to hold others responsible for their own stupidity and/or misfortune are slimeballs, and that justice in this case would be amply served if the two sets of slimeballs were given the opportunity to settle their differences in a mud-wrestling arena, with medieval weapons. The event could be televised, and the ad revenues could go to the survivors.
