I am what you would call a "pretty strict constructionist". I think that it is the judges task to apply the law, not make it. On the other hand, I admit that novel situations arise, and that it is more efficient if they can be disposed of in the court than wait for legislative action. For that reason, analogical thinking and generalization is reasonable up to a point, and plausible results suffice. The problem with Roe is the pretense that privacy was ever regarded as so sacrosanct that it trumped the state's interest in the protection of human life, in conjunction with the pretense that the court is competent to supercede legislative determinations in that area........
