Graham's court appointed counsel was incompetent. Graham did not have the means to hire Johnny Cochran Citing trial testimony neglects what the incompetent "defense" attorney didn't admit as evidence which should have been included and which should have allowed for a new trial. Even such a staunch advocate of capital punishment as Pat Robertson, head of the Christian coalition, is urging Governor Bush to stop Graham’s execution. In fact, Graham’s new attorneys know of six other eyewitnesses at the store on the night of the killing who say Graham was not the shooter. Ron Hubbard is one of them. RON HUBBARD: They called me in to view the lineup. And I did not recognize the person who I saw that night in the parking lot. And after I did that, they said, ‘Well, thank you for your assistance.’ Cashier Sherian Etuk also witnessed the murder from a distance and went to the police station. She says the murderer was shorter than Gary Graham. Graham’s court-appointed attorney, Ronald Mock, failed to call either Hubbard or Etuk to the stand, even though both were identified in the police report. And the ballistics report showed that the .22 caliber bullet that killed Lambert was not fired from the gun that Graham was arrested with, but Graham’s attorney never mentioned that piece of evidence to the jury either. Tonight, the former co-counsel defending Gary Graham said he now regrets the decision not to introduce the ballistics report, and he tried to explain why the defense called no witnesses. No physical evidence has ever been found that links him to the crime. And Graham’s new attorneys claim that the one eyewitness, Bernadine Skillern, picked him out of the lineup after being shown a highly suggestive series of photographs. The description of the shooter was a young black male, no mustache, no beard, one-inch compact Afro haircut. Now let’s look at the photographs that she was shown. If you look at the top, you see that this fellow has a mustache and bushy hair. This fellow has bushy hair. This fellow has both bushy hair and a mustache. This guy has both bushy hair and a mustache. And there’s only one picture there that has a short haircut and no facial hair. And guess who it is? It’s Gary Graham. Now why wasn't she shown a number of photographs of people w. similar characteristics that fit the description and not just one? Two jurors who sentenced Graham to death now say they would have found him not guilty had they heard all the evidence. BOBBY JOE PRYOR [juror] After hearing all this new evidence, I just don’t believe he’s guilty. BOBBY JOE PRYOR: He [the 'defense" attorney] just didn’t present to me or any kind of fight for the guy. Seemed like he didn’t- it was just one-sided. Presumed guilty until proven innocent...too late...thus let's just kill an innocent man and some how rationalize it. z
