It's possible, But I think JDSU will meet plenty of resistance to prevent it from reaching that high by the end of next week. The tech rally is about over for the summer imo. Maybe one more attempt at NASDAQ 4400 and then hemmed back down in a trading range.

The index funds do not have to have it in their funds by the add date. I believe the grace period is up to two weeks following the add date.
