Can somebody with a legal brief explain to me why this arrangement isn't a restraint of trade in the monopoly sense?

It would seem that a refusal by INTC to license VIA to put a connection to DDR or DDR-II on a P4 motherboard plus this agreement would be a fairly airtight case.

Or is the threat of AMD in the marketplace sufficient to give INTC/RMBS a defense to such an argument? ...But then I thought that INTC was still contesting VIA's right to service AMD with chip sets using AGPx4 and other proprietary INTC technology.

I hate to post and run, but I will check for any replies tonight. ... I hope.
