Well, it depends a lot on what things are included as rights, and what the hierarchy of rights might be. For example, I do not have a right to sue someone for driving me out of business through competition, but I do have a right to sue someone for harming my business through libel. I do not have a right to stay in business, but I do have a right to be compensated for certain kinds of harm. In a situation like this, the concept of fairness is somewhat more helpful than the concept of infringement........
