I think I'd characterize that as "most likely" or "best case". Certainly not worst case.

My comment was based on all the analysts I've read plus what was said on the merger conference call. With the recent news that LU is spinning off its microelectronics unit and the rumor that NT may do the same, the competitive landscape is strengthing, making worst-case scenarios less grim.

Reading over JDSU's SEC documents re: ETEK merger, I have to believe they learned what the DOJ expects and will have the necessary documents delivered up-front, not wait for a special request. If they anticipate what's required, they'll shorten the process.
