Patents have been catagorized an 1) essential and 2) helpful. QCOM will assign Spinco a portion of each while keeping a portion of each.

In Snyder's upgrade, he specifically noted that Q had 10 "essential" patents, 3 of which will go to Spinco (god I hope they keep the name!).

Would expect that this view came from NOK, along with the remainder of Snyder's research...
