I posed this question with the royalty costs as a secondary item, compared to the ability of someone else coming out with more efficient/better chips with the same IPR (licensed or owned).

subsequent discussions here have me thinking favorably about the phrase "xyz is licenced to use QCOM+SPINCO patents". key phrase there being "licensed to use" ie. not "licensed to modify..."

that changes the scenario big time.
