Independent counsel Robert Ray said there "was no substantial and credible evidence" that the first lady or top officials were involved in seeking the files on Republicans. Ray's final report echoed the wording of his announcement March 16 that he would not be prosecuting anyone in the FBI files investigation. Last month, the independent counsel concluded that the first lady had an indirect "role" in the 1993 firing of the White House travel office staff, but had committed no crime in that matter. The White House has said hundreds of FBI file summaries on former Reagan and Bush administration staffers were obtained in late 1993 and early 1994 because of a clerical error. The relatively new Clinton administration was under pressure to complete long-delayed security clearance investigations of new staffers, and the White House said the Secret Service supplied its security office with an old list of those needing clearance. The independent counsel's final report lends credence to the White House assertions. Ray's final report concentrates extensively on the activities of Anthony Marceca, a civilian Army investigator who was on detail to the White House for the security clearance process. Marceca invoked his Fifth Amendment privilege not to incriminate himself when called as a witness in congressional hearings in 1996. But Marceca was granted immunity by the independent counsel's office to ensure his cooperation with the probe after investigators determined that the first lady and other White House officials were not involved in obtaining the file summaries. Ray said in a statement Friday that his investigation "showed that Mr. Marceca requested FBI background reports using a list that did not distinguish between 'active' and 'inactive' (White House) passholders. The evidence regarding Mr. Marceca's use of the list suggested that Mr. Marceca did not target specific individuals to obtain their background reports." The independent counsel said there was "no evidence" that Marceca tried "to conceal his requests for background reports of individuals who no longer required access to the White House." Marceca even notified "the supervisors in the former offices of the individuals whose background reports he had requested of the need for those individuals to obtain a new background investigation (for clearance)." Ray said the notification "suggests that Mr. Marceca did not request the background reports to collect derogatory information on political opponents of the current administration. Rather it suggests that Mr. Marceca erroneously believed that the (Republican) individuals whose reports he requested were still employed at the (Clinton) White House and needed access." Ray blamed Marceca's alleged mistakes on "the lack of supervision, training and experience," but said the "sheer number of reports produced by the FBI to Mr. Marceca should have raised concerns and prompted corrective action." The independent counsel concluded that some of Marceca's testimony on the matter before a House committee "was false," but said he "declined to prosecute him because such a prosecution would not serve the purpose for which an independent counsel was appointed in this matter." Ray also released a final report on the investigation into former White House counsel Bernard Nussbaum. The report cleared Nussbaum in language that also echoed the March 16 announcement.
