You raise an interesting point. Can an anonymous person only known publicly by an alias on a chat board be libeled? At first, my instinct is to say yes, as long as some third person knows who "Scumbria" really is, and therefore Scumbria can prove that a false and damaging statement about him, communicated to some third party, harmed his reputation. Hmmm....

Since SI employees know his real identity, are they third parties whom Scumbria could call upon in a lawsuit? I don't know. Maybe. If it were defamation per se, "Scumbria" wouldn't have to prove actual damages, would he? Hmmm....

Interesting question. Maybe I'm missing something here in my analysis. Anyone out there have anything to add?

Barry, I think Scumbria learned the word and the meaning of libel from me. He knows fully well that what you have said is correct. The name Scumbria, even though I post to The Stupid Guy, are both vapor. Alias names mean nothing in libel charges. At least Mickey Mouse has a copyright and patent on his name therefore libelous statements about Mickey could mean something. Libel is in the fictitious mind of Scumbria only. But The Stupid Guy knows all this. His running at the mouth of libel is just BS and he knows it. Let's move on to the reasons why.

Last week I made the following post on the AMD thread after Daniel Schuh made statements to the effect that Rambus was involved in a scam. This offended me. I attempted twice to get a clarification from Daniel Schuh. He would not reply to my requests and I made the following post. Since that time Scumbria and others. especially Scumbria, have ridiculed my position with their cute little innuendos. I felt it was one thing to make negative remarks regarding Rambus and another to accuse the company of illegal activity. You can go back to the AMD thread and read the posts prior and after the post below. You can also review Dan Schuh's posts since then which have now toned down with a little more thought being given to what he is saying. You be the judge.

It is now apparent that you have no intent of responding to my request for clarification regarding your claim that Rambus is involved in some sort of a scam. For a smart guy you lack a great deal of legal common sense. Apparently nobody ever told you that you can't make libelous statements against a person or company on a public forum accusing them of committing a fraud without expecting some consequences to your action. The last time I looked in a dictionary the definition for scam was... A fraudulent business scheme; a swindle. None of which I have any knowledge of in this case, but you apparently do. Such a remark on a public forum like SI if taken at face value can cause investors like myself great financial loss and I am not going to allow you to do that. Rest assured I am going to do everything in my power to protect my investment in Rambus and put a stop to any further remarks from you regarding Rambus' involvement in any such activity. I will be contacting the SI Webmaster, and Rambus legal department. It will be their decision to follow procedure and notify the SEC since they are the injured party. Since you choose not to explain your comments to me and the thread you will now have the opportunity to explain to them. As you would say...
