FWIW: COMS spun-off PALM in Feb 2000, exactly 24 mos. after acquiring it in the USRX purchase. At the time the spin-off was announced there was some discussion that a tax-free ruling on the distribution was dependent on proving the spin-off was part of a bona fide reorganization. Subsequent rumors of a purchase of COMS similarly have inspired rejoinders that this would be unlikely within the next 2 years because of presumptions the IRS applies.
