California Judge Rules SDLI Infringed Rockwell Patent
FY00E: $1.38, FY01E: $2.00

· Rockwell suit has been active since 1995 and current decision reflects minor judges ruling; Trial date is scheduled for April 2001 (no change); We view announced ruling as a non-event.

· Rockwell’s suit asserts that SDLI infringed on patents pertaining to the manufacturing process of semiconductor lasers, however, these patents expired at the beginning of 2000.

· While we would assign a 50/50 probability to SDLI winning the case, if SDLI loses, we believe the dollar amount of potential damages would be inconsequential and restricted to a one-time payment as opposed to ongoing royalty payments.

· We continue to view SDLI as inexpensive way to buy JDSU (24.7% arbitrage spread) and as an attractive investment based upon outstanding fundamentals as a standalone entity; Reiterate BUY.
