Cosmo, "prior claims" are generally based on ethnicity, not race. Note, for example, that when Nstive Americans present land claims, they do so as members of a particular tribe/ethnic group, not as members of a "race."

And frankly, I think that the "prior claims" argument deserves a little more consideration than you seem to allow. Of course, people have been invaded/displaced/exterminated/etc. throughout history, with the bigger guy generally imposing his will on the smaller one, but the process has to stop sometime/somewhere.
